1. Acceptance of Terms

By accessing and using Longevity ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Longevity is a personal health and wellness tracking application that allows users to:

• Log sleep, movement, drinks, water, energy, mood, and clarity
• Review patterns and cited long-range estimates from those logs
• Use crisis tools and an optional adaptive Coach
• Export and manage personal data

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to terminate or suspend your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity (12+ months)

4. User Conduct

You agree NOT to:

• Use the Service for any illegal purpose or to violate any laws
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Impersonate another person or entity
• Harass, abuse, or harm another user
• Scrape, crawl, or use automated tools to access the Service
• Reverse engineer or attempt to extract source code
• Resell or commercialize the Service without permission

5. Intellectual Property

5.1 Our Property

The Service, including all content, features, and functionality, is owned by Longevity and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Data

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to:

• Store and process your data to provide the Service
• Process your Coach message and recent context with Google Gemini only if you turn on adaptive replies

6. Medical Disclaimer

IMPORTANT: Longevity is NOT a medical device, diagnosis tool, or replacement for professional medical advice.

The Service:

• Is for informational and tracking purposes only
• Does NOT provide medical advice, diagnosis, or treatment
• Should NOT be used for medical emergencies (call 911 or emergency services)
• Is NOT FDA-approved or HIPAA-compliant
• Should NOT replace consultation with qualified healthcare professionals

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or tracked in Longevity.

8. Smart Services Disclaimer

Adaptive Coach replies may be generated using Google Gemini. Please be aware that:

• Generated insights may not be accurate or applicable to you
• Insights are based on patterns in your data, not medical knowledge
• The system can make mistakes or generate inappropriate content
• You should critically evaluate all generated suggestions

9. Data Export and Deletion

You have the right to:

• Export your data in JSON format at any time
• Request deletion of your account and associated data through support
• Request a copy of your data by contacting support

When an account-deletion request completes:

• Active account data and the login are removed without an in-app recovery period
• Service-provider backups expire under the provider's retention process
• Backups are not used to restore the deleted account

10. Fees, Subscriptions, and Payment

Longevity offers both a free tier ("Tracker") and a paid subscription ("Centenarian") with unlimited Coach conversations and Trends history beyond the free 30-day window.

Subscription Terms

• Centenarian Plan: Available at $6.99/month or $59.99/year. Prices may vary by region and are displayed in your local currency at checkout.
• Free Trial: New subscribers may receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time. On iOS, manage your subscription through Settings > Apple ID > Subscriptions. On Android, manage through Google Play Store > Subscriptions. On web, manage via your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund policies are governed by the platform through which you subscribed (Apple App Store, Google Play, or Stripe). Contact the respective platform for refund requests.
• Price Changes: We may change subscription prices with at least 30 days' advance notice. Price changes will take effect at the start of your next billing period.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LONGEVITY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Personal injury or health issues arising from use of the Service
• Errors or inaccuracies in generated insights
• Service interruptions, downtime, or data loss
• Third-party services (Firebase, Google Gemini, etc.)

Our total liability shall not exceed the amount you paid us in the preceding 12 months.

12. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Data will be accurate, reliable, or complete
• Defects will be corrected
• The Service is free of viruses or harmful components

13. Indemnification

You agree to indemnify and hold harmless Longevity from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or data you submit

14. Third-Party Services

The Service relies on third-party platforms:

• Firebase/Google Cloud - Data storage and authentication
• Google Gemini - Personalized insights generation
• Vercel - Application hosting

We are not responsible for:

• Outages or issues with third-party services
• Changes to third-party terms or pricing
• Data breaches or security issues at third-party providers

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will show changes by:

• Updating the "Last Updated" date
• Publishing the updated Terms at this same in-app path

Continued use of the Service after changes constitute acceptance of the new Terms.

16. Governing Law and Disputes

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved through:

• Good faith negotiations first
• Binding arbitration if negotiations fail
• Small claims court (at your option)

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Longevity regarding the Service.
